These Terms of Service (“Terms”) govern your access to and use of the Pratfoundy mobile application and any related services (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
1. Service Provider
The Service is operated under the brand Pratfoundy by an individual resident of Latvia (“we”, “us”, or “our”). Pratfoundy is currently an unregistered brand name and does not constitute a separate legal entity.

2. Eligibility
To use the Service, you must be at least 13 years old and have the legal capacity to enter into these Terms. The Service is not intended for children under the age of 13. By accessing or using the Service, you confirm that you meet this age requirement.
3. Account Registration
Use of the Service requires the creation of an account, and no guest access is available. You may register using an email address and password or through supported third-party authentication providers, including Google, Apple, Facebook, and LinkedIn.
Each user is permitted to maintain only one account. Creating multiple accounts, sharing accounts, or attempting to circumvent usage limits is strictly prohibited and may result in restriction, suspension, or termination of access.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. We are not responsible for any unauthorized access resulting from your failure to adequately secure your account.
4. Subscriptions and Purchases
The Service may include paid features, such as monthly subscriptions, annual subscriptions, and a one-time purchase that grants full and unlimited access to all features. A 7-day free trial may be offered where permitted by the applicable platform.
All payments are processed exclusively through the Apple App Store or Google Play Store.
We do not process payments directly and do not store or have access to your payment information.
Subscriptions renew automatically unless cancelled through your app store account settings and are billed in accordance with the terms and policies of the relevant platform.
All refunds, cancellations, and billing disputes are governed solely by the policies of Apple or Google, as applicable. We do not issue refunds directly.
5. Educational Content Disclaimer
The Service provides educational content only, including content related to entrepreneurship, business concepts, finance fundamentals, management, and strategy. All content is provided strictly for informational and educational purposes.
The Service does not provide financial, legal, tax, investment, or business consulting advice. You should consult qualified professionals before making any financial, legal, or business decisions based on information obtained through the Service.
6. No Guarantees
We make no guarantees or representations that you will achieve any particular results, that your business will be successful, or that your income, skills, or performance will improve. Any outcomes depend on numerous factors beyond our control, including your actions, effort, market conditions, and external circumstances.
7. Intellectual Property
All content available through the Service, including text, lessons, questions, structure, design, branding, logos, and software code, is owned by Pratfoundy or licensed from third parties and is protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for your personal, non-commercial use. You may not copy, reproduce, distribute, resell, share outside the Service, use for commercial purposes, or reverse engineer any part of the Service or its content.
8. Third-Party Content
Certain content within the Service may be provided by third parties. We do not guarantee the accuracy, completeness, or reliability of such content and accept no responsibility for it.
9. Prohibited Conduct
You agree not to violate any applicable laws or regulations, abuse or harm other users, attempt to bypass technical limitations, manipulate progress, XP, or achievements, or use the Service for unlawful, deceptive, or misleading purposes.
10. Suspension and Termination
We reserve the right to restrict, suspend, or terminate your access to the Service only in extreme or justified cases, including serious violations of these Terms, abuse of the Service, security risks, or legal obligations. Where immediate action is required, we are not obligated to provide advance notice.
11. Account Deletion
Account deletion is available only upon request through support. To request deletion of your account, contact us at info@pratfoundy.app. Upon deletion, your account data will be removed or anonymized, subject to legal and technical limitations.
12. Service Availability
We do not guarantee that the Service will be uninterrupted, error-free, or continuously available. We reserve the right to modify or discontinue features, temporarily suspend the Service, or permanently shut down the Service at any time without liability to users.
13. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, consequential, or economic damages, including business losses, lost profits, lost revenue, or loss of data. Use of the Service is entirely at your own risk.
Where liability cannot be excluded, our total liability shall not exceed the amount paid by you for the Service during the twelve (12) months preceding the claim, or zero if the Service was used free of charge.
14. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising out of your use of the Service, your violation of these Terms, or your violation of applicable laws.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of Latvia, without regard to conflict-of-law principles. Any disputes arising out of or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Latvia.
16. Changes to These Terms
We may update these Terms from time to time. Any changes become effective upon publication within the Service. Continued use of the Service after such changes constitutes acceptance of the updated Terms.
